Terms of Service for Take it Digital, LLC:
1. Introduction
Take it Digital, LLC provides professional real estate, commercial, construction, rental, hospitality, and marketing media services. By scheduling or using our services, you agree to these Terms of Service (TOS).2. Services Provided
- Interior and exterior photography
- Aerial drone photography and videography
- Floor plans and property measurements
- Virtual tours (Matterport, Zillow 3D, CloudPano, etc.)
- Short-form vertical videos and reels
- Full property, commercial, builder, and community video tours
- Virtual twilight edits
- Virtual staging and digital enhancements
- Media editing, post-production, and property website creation
- Construction progress documentation
3. Scheduling and Booking
Appointments may be scheduled through our online scheduling platform or by calling Take it Digital, LLC directly. For phone bookings, appointment details will be entered into our scheduling system and a confirmation email will be sent to the client. Appointments are not officially confirmed until a confirmation email is received. The rates shown in the scheduling system at the time of booking are the official rates. Availability is first-come, first-served.4. Payment Terms
Payment is due upon completion of services unless otherwise arranged. Rates shown at the time of scheduling are honored. Deposits may be required for large commercial projects. Tips are optional and appreciated.5. Media Ownership and Usage Rights
Take it Digital, LLC retains full copyright to all media created. Clients receive a non-exclusive license for marketing use. Media cannot be resold or licensed to third parties without written permission. Unless otherwise agreed, Take it Digital may reuse media for portfolio and marketing purposes.6. Client Responsibilities
Clients must ensure the property is fully prepared and accessible. Unprepared properties may incur trip fees or reshoot charges. Properties must be safe for photographers and drone operators.7. Cancellation and Rescheduling
Cancellations must be made at least 24 hours before the appointment. Same-day cancellations or access issues may incur a fee. No refunds are issued once services are delivered.8. Drone and FAA Compliance
Aerial services are subject to FAA regulations, weather, airspace restrictions, and safety requirements. If conditions prevent drone operation, aerials may be omitted without discount.9. Certified Drone Pilots
All aerial operations are performed exclusively by FAA Part 107–certified drone pilots. Some locations may require FAA authorization. Availability depends on legally safe operating conditions.10. Independent Drone Operators, FAA Certification, and Liability Disclaimer
Take it Digital, LLC contracts independent FAA-certified drone operators. Under federal law (14 CFR Part 107), the Pilot in Command (PIC) holds full legal responsibility for maintaining certification, evaluating safety, obeying regulations, obtaining authorizations, and reporting incidents. These duties are mandated by federal aviation law. Take it Digital, LLC is not liable for:- Expired or lapsed FAA certifications
- FAA violations or penalties
- Drone crashes or equipment failures
- Property damage, injury, or death arising from aerial operations
- Claims or lawsuits related to drone operation
- Negligence or operational errors by drone operators
11. Workers’ Compensation and Independent Contractor Status
Take it Digital, LLC works with independent contractors, including photographers, videographers, editors, and drone operators. Contractors are responsible for their own Workers’ Compensation coverage. Take it Digital, LLC is not liable for contractor injuries or claims.12. Turnaround Times
Photo turnaround is typically next business day. Videos, virtual tours, and virtual staging may require additional time depending on complexity and workload.13. Limitation of Liability
Take it Digital is not responsible for delays caused by weather, FAA restrictions, technical issues, traffic, or emergencies. Liability is limited to the total amount paid for the service.14. Indemnification
Clients agree to indemnify and hold harmless Take it Digital, LLC from claims arising from misuse, alteration, or unauthorized distribution of media.15. Confidentiality
We maintain confidentiality regarding client information, project details, and sensitive property data unless written permission is granted.16. Dispute Resolution
Disputes must be resolved through mediation or arbitration before litigation.17. Amendments
Take it Digital, LLC may update these Terms at any time. Significant updates will be posted on our website or communicated via email.18. Governing Law
These Terms are governed by the laws of the State of Florida, with venue in Hernando County, FL.19. Short-Term Rental and Hospitality Terms
Units must be cleaned and staged prior to the shoot. Access must be confirmed in advance.20. Travel Fees
The first 40 miles from the photographer’s starting point are included. Additional mileage is billed according to our travel fee schedule.21. Reshoot Policy
Reshoots due to property unpreparedness or client changes require a new appointment and fee. Reshoots for photographer error are provided at no charge.22. Data Protection and Privacy
Client information is used solely for service communication and stored securely.23. Force Majeure
Take it Digital is not liable for delays caused by events beyond our control such as severe weather, emergencies, or natural disasters.24. Intellectual Property
All trademarks, branding, workflows, and proprietary processes remain the exclusive property of Take it Digital, LLC.25. SMS Communication Policy
By providing your phone number, you consent to receive SMS reminders and updates. Message frequency varies. Reply STOP to unsubscribe or HELP for assistance.26. Video Production Terms
- Dual-format videos (horizontal + vertical) are billed separately.
- Editing preferences must be communicated before filming.
- Advanced effects may incur additional fees.
- Turnaround varies by project complexity.
27. Commercial and Builder Project Terms
- Multiple site visits are billed separately.
- Drone access depends on FAA regulations.
- Job sites must be safe and accessible.
- Media is for marketing/documentation only unless contracted otherwise.
28. Virtual Staging and Digital Enhancements
- Clients must specify staging style before editing.
- Standard turnaround is 1–2 business days.
- One round of minor revisions is included.
- No refunds once staging begins.
- Clients are responsible for MLS compliance.
